I'm not aware of any issues and see "popular tweets" returned both when requested in mixed and popular-only modes:

GET http://search.twitter.com/search.json?q=google&result_type=mixed

GET http://search.twitter.com/search.json?q=google&result_type=popular

Are you including the result_type parameter?
